TERMS & CONDITIONS
Terms used in this document are defined as follows:
These General Terms and Conditions and the contained within provisions define the rights and obligations of the Parties within the scope of the provided by Tuscany Forever booking process.
Booking shall be binding only following acceptance by Tuscany Forever through confirmation of the booking made via e-mail. Prior to the issue of e-mail confirmation of the booking, Tuscany Forever reserves the right to refuse any booking.
Every effort has been made in order to guarantee an enjoyable and memorable holiday, if however any cause for complaint arises it is essential for the Customer to report such cause immediately, in order to allow us to take remedial actions as soon as possible. If the complaint can’t be dealt with during the stay, Customer is to submit such complaint by e-mail or in writing within 28 days counted from the Departure Day.

This „Cancellation Policy” constitutes the integration part of our “Terms&Conditions” published on our WWW pages (“2. Cancellation or amendment of booking”).
1. Cancellation or amendment of the booking must be done by telephone or by e-mail. In case of telephone cancellation or amendment request they shall take effect, if the Customer confirms such a request in writing or by e-mail.
2. Customer has the right to cancel the booking:
a. within 7 days of receiving confirmation e-mail, with the right to prompt refund of any and all payments made to Tuscany Forever;
b.later than within the deadline specified in the provision above, but 21 days prior to the Arrival Date, in which case Tuscany Forever shall have the right to retain any Advance payments.
c. Later than 21 days prior to Arrival Date, in which case Tuscany Forever shall have the right to retain the whole payment.
d. In case of lack of the balance payment 21 days prior to the Arrival Date, Tuscany Forever reserves the right to cancel the booking unless the booking is submitted less than 21 days prior to the Arrival Date and the payment is made in 100% at once.
3. Customer declares the awareness of the fact that the availability of services and facilities provided by Tuscany Forever Estate depends on the season of the year. Detailed information on the availability of services and facilities during the booked period can be acquired from Tuscany Forever.
4. Tuscany Forever reserves the right to cancel or amend the booking in case of extraordinary objectively justified circumstances, such as force majeure or other circumstances beyond its control make the fulfillment of the booking terms impossible. Customer shall be informed of the amendments or cancellation promptly.
GENERAL PROVISIONS:
These By-laws contain rules applicable in the area of the Tuscany Forever in Saline di Volterra, Montescudaio and Montecatini to the use of apartments, villas, the swimming pools and other facilities available in the Estate.
The Estate is administered by Villa alle Monache GmbH with its branch established in Italy (societa consitutua in base a leggi di altro stato) and with its second registered office in Castagneto Carducci (Livorno), Via Aurelia 2/E 57024.
These By-laws are binding upon all Guests, i.e. those who rent apartments or villas and to all those who enter the area of the Estate. A Guest is responsible for people who have been invited by the Guest to visit the Estate and who have not checked in.
DETAILED PROVISIONS:
CHILDREN
Children and young people up to 18 years of age may only stay in the area of the Estate under the supervision of their legal guardians, who take full responsibility for their safety and all potential damages caused by them.
RECEPTION
The Reception is open every day , opening hours are displayed at the Receptions’ door.
CHECK IN AND CHECK OUT
The Guests may arrive to the Estate and check in from 4.00 pm.
All Guests who end their stay are requested to vacate their apartments or villas, check out and leave the Estate by 10.00 am.
The Guests have the right to alter the time of check in and check out by not more than 2 hours, provided Tuscany Forever’s prior consent to such a request.
In exceptional circumstances, Tuscany Forever reserves the right to accommodate the Guest in another apartment or villa of the same standard, than the one originally booked by the Guest.
CLEANING
Cleaning fee of the rented villa or apartment at the end of the rental shall be calculated under the terms of the Booking Contract.
Upon request Tuscany Forever can provide an additional, extra paid cleaning service. More information can be acquired in the reception.
CURFEW REGULATIONS
In order to ensure the comfort of all guests, night-time/bed time/curfew in the Estate is from 11.00 pm to 6 am.
Especially during the night-time/bed time/curfew the behaviour of the Guests shall not disturb the quiet and peace of others. No noisy activity is allowed.
THE SWIMMING POOL
All persons using the pool do so at their own risk and sole responsibility. The Tuscany Forever accepts no liability for the injury, death or loss associated with the use of the pool, e.g. articles of clothing, valuables, etc.
Leaving a child unsupervised in or near swimming pool(s) even for a second is PROHIBITED.
Glass, inappropriate toys (e.g. fragile), inappropriate behavior (e.g. running, pushing, spitting and blowing the nose) is not allowed in the pool area.
For hygienic reasons all people are obliged to take a shower before swimming.
Appropriate swimwear must be worn in the pool. Kids wearing diapers, are only allowed in to the pool, when wearing rubber pants.
CARS AND OTHER VEHICLES
Driving any motor vehicles in the Estate is prohibited, with the exception specified in point 3 below.
Vehicles may only be parked in the indicated car park zone.
Motor vehicles are allowed in the Estate only within the specified time on the day of check-in and check-out. Maximum speed in such case is 15 km per hour.
BONFIRE AND BARBECUING
While using the BBQ:
The following practices are prohibited in the Estate:
WATER
We are working to serve and protect the environment. Tuscany Forever Residence has installed an ecological water supply system. Please use the water efficiently due to years of drought in the Tuscany region.
WASTE
Tuscany Forever does not collect the Guests’ garbage.
Collected wastes HAVE TO BE RECYCLED by the Guests (in Italian known as raccolta differenziata).
All wastes are to be placed in the appropriate garbage containers located at the end of the access way in front of the warehouses on the opposite side of our road
Each container has a description for which kind of garbage it might be used( glass/ plastic/ paper etc)
TOWELS AND BEDCLOTHES
Towels and bedclothes in the apartments are designed for indoor use only. Tuscany Forever provides pools towels which can be rented at the reception at additional cost .
FURNISHHINGS
All pieces of furniture and other accessories in the apartments and villas should be used with necessary care. To avoid damages and early wear of furniture or upholstery, please avoid staining them with the alimentary products. It’s prohibited to carry them out and use outside the buildings, unless specified otherwise on the furniture.
If a piece of furniture is damaged, security deposit shall be used to cover the costs of repair or restoration.
ELECTRICITY
Two types of sockets are installed on the premises of the Estate:
Please choose carefully an adequate one fitting Your equipment. Tuscany Forever has exercised the highest level of diligence in completing wiring systems, therefore it does not accept any liability for personal injuries and property damages caused by the use of electric sockets and switches.
HEATING FEES
All guests agree to cover the costs of gas used to heat the property at the time of Rental, according to the rates set by providers and Tuscany Forever, upon arriving at the Estate.
The heating fee is published on our WWW pages and vary depending on the apartment.
SMOKING
Smoking is not allowed indoors. That is in apartments, villas and any interiors of all buildings, i.e. passageways, corridors, halls.
Smoking is only allowed in outdoor areas of the Estate, however make sure that it doesn’t disrupt other Guests’ comfort.
Tuscany Forever reserves the right to impose fines on those who breach the above regulations prohibiting smoking. The amount of the fine will correspond to the costs incurred on additional cleaning of rooms necessary to remove the consequences of smoking.
THE WELL
For the sake of our Guests safety, the use of the well located in the Estate is prohibited. Tuscany Forever does not accept any liability for personal injuries and property damages resulting from the violation of this ban, in particular for injuries and damages resulting from the circumvention of security devices preventing access, and resultant falls.
MONITORING
Be aware that for our common safety there are some cameras installed in the open air area of the Tuscany Forever Resort. None of the cameras monitor our apartments or restricted places (bathrooms, toilets, changing rooms). Only authorised staff of Tuscany Forever may access the recorded data. The data mustn’t be transferred, copied or shared with anybody. Only legal authorities may access the data upon the relevant request.

Villa alle Monache with head office at Castagneto C.cci. Donoratico (LI) via Aurelia 2/E, the owner and the only administrator of Tuscany Forever Residence (including podere Berti and podere Acquaviva), presents this document in relation to UE resolution No. 2016/679 dated 27.04.2016.which came into force 24.05.2018 on personal data protection and free movement of such data.
Villa alle Monache declares that it collects personal data in the scope which is necessary for business purposes and/or local, Italian law requirements.
The data of our customers is registered in order to complete a rental contract and meet requirements of the Italian law on tourists registration.
Suppliers and subcontractors data is registered in order to properly execute business goals with a relations to a particular supplier or subcontractor.
The data is used for statistics purposes as well.
The data is processed in line with the highest standard of protection, transparency and control. The data is not transferred to any country outside EU.
THE SCOPE OF RECORDED PERSONAL DATA

DATA REGISTRATION AND ARCHIVE
Data is recorded in a relevant scope in the following way:
1. In rental contracts both: paper and electronic
2. In Bookalet, a booking electronic system
3. In registration forms filled up by a customer at the arrival
4. In Excel sheets
5. In the CRM system
6. In confirmation of payment documents
7. In invoices and credit notes
Paper documents are archived in the Villa alle Monache office (via di Casa alle Monache , Saline di Volterra) which is protected by locks.
Electronic data is archived on company computers or a professional cloud with a limited access accessible only to a level of users’ by formal authorization.
Suppliers and subcontractors data is archived during the time of co-operation with a particular party and is stored at least for 5 years. Customer data recorded on paper is archived for 5 years; electronic customer data is archived for undefined time period.
SOURCES OF PERSONAL DATA
Villa alle Monache collets personal data from the following sources:
1. Electronic, contact forms published on www.tuscanyforever.it
2. Personal data collected by phone
3. Personal data collected by mails
4. Registration forms of the Bookalet system used in automatic booking process
5. Contracts with customers, suppliers and subcontractors
6. Suppliers and subcontractors invoices (if personal data is applicable)
INFORMATION FLOW
Customer personal data is transferred to the Italian police system according to requirements of a tourist registration and to a tax system of a local administration (Comune di Volterra) in order to register a tourist tax. Personal data recorded on paper is transferred to local administration in Livorno in order to register a tourist tax.
People who have an access to customer, suppliers or subcontractor personal data are contractually authorized by Villa alle Monache to deliver professional services, such as: booking process management, operations management or financial control.
Suppliers and subcontractors data is transferred to the accounting office: Studio Contabile, Leonardo Carollini , Cecin, Italy.
Data might be transferred to E-Marka – IT company, located in Cracow , Poland but only for technical purposes. E-Marka has signed a declaration that all data is destroyed immediately after completing its’ service.
YOUR RIGHTS
Everybody whose data is recorded by Villa alle Monache , has a right to review his/her personal data.
Everybody whose data is recorded by Villa alle Monache has a right to modify his/her personal data but only in the scope which doesn’t impact a possibility to execute business procedures and it is in line with legal regulations. Such a request has to be submitted in written by e-mail addressed or by traditional letter addressed to the head office of Villa alle Monache.
If a customer, supplier or subcontractor denies to deliver necessary personal data, Vila alle Monache doesn’t deliver any service or doesn’t complete any contract.
Everybody whose data is recorded by Villa alle Monache has a right to submit a complain to a relevant national authority of personal data protection based on art.51 of the UE Directive No. 2016/679 (in Italy: Autorita’ Garante dei Dati Personali )
The personal data is not used by Villa alle Monache for marketing purposes without a customer/ supplier/subcontractor permission. A customer permission or his/her direct enquiry allows Villa alle Monache to present a marketing offer.
